Brazil opens 45-day public consultation on operational capacity rules for betting suppliers

The Brazilian Ministry of Treasury has initiated a 45-day public consultation to draft new regulations governing the recognition of operational and technical capacity for service providers in the fixed-odds betting sector. 

Detailed in Public Consultation Notice SPA/MF No. 1/2026 and published in the Official Gazette of the Union, the process is open to individuals and legal entities from February 4 to March 23, 2026.

Contributions must be submitted through the federal Portal Brasil Participativo via the designated link titled Recognition of the technical and operational capacity of service providers for betting operators – Brasil Participativo. Only submissions received within the official window will be considered valid.

The consultation responds to mandates outlined in Decree No. 11,907 of January 2024 and Laws No. 13,756 (2018) and No. 14,790 (2023), which require regulatory frameworks for suppliers offering services to licensed betting operators. According to the Ministry, the proposed regulation will set standards to assess whether suppliers have the necessary operational capacity to serve Brazil’s legalized betting market.

Oversight of the process is being handled by the Prizes and Betting Secretariat (SPA), which falls under the Ministry of Treasury. After the consultation period closes, the SPA will evaluate all submissions in accordance with Article 31 of Decree No. 12,002, dated April 22, 2024. A technical team will review the feasibility of each suggestion before incorporating relevant inputs into a final ordinance.

The Ministry stated that this public engagement process is intended to improve regulatory enforcement and promote legal certainty across the national betting market.

“A public consultation is hereby opened to obtain contributions and information for the preparation of the Regulation on the Recognition of the Operational Capacity of Suppliers of Fixed-Odds Betting Agents in Brazil,” the notice reads.

The Acting Secretary of Prizes and Betting, Daniele Correa Cardoso, issued the notice in her official capacity under Article 55 of Decree No. 11,907. The Ministry of Treasury is to publish the results of the technical review after the consultation concludes.
