Despite previous failed attempts to legalize and regulate daily fantasy sports in the state, Senate (S 374) and House (H 223) versions of a DFS bill have now emerged.

Although the Florida legislature will not return to session until 2018, Rep. Jason Brodeur and Sen. Dana Young have both introduced fantasy sports bills to be considered when the state's legislative session kicks off.

Both bills would clarify the legality of paid-entry fantasy sports in the state. As Brodeur alluded to, a 1991 attorney general’s opinion said that paid-entry fantasy sports is illegal under Florida's gambling laws.

Current AG Pam Bondi has not weighed in publicly on the applicability of that opinion to the current landscape.
