NIGC did not approve DFS plans - official comments

The National Indian Gaming Commission on Thursday rebutted Atlantis Gaming Corp.’s recent assertion that the commission approved the company's online betting and daily fantasy sports platform tied to Native American casinos.

The National Indian Gaming Commission on Thursday rebutted Atlantis Gaming Corp.’s recent assertion that the commission approved the company's online betting and daily fantasy sports platform tied to Native American casinos.

Atlantis Gaming had claimed in a Monday press release that the company received permission from the NIGC and the U.S. Department of Justice for the “first federally approved online betting and DFS [daily fantasy sports] platform.” The commission disputed that Thursday.

Following is the statement by the NIGC commenting on "Recent Press Release Regarding Daily Fantasy Sports":

 

On October 17, 2016, Atlantis Gaming Corporation issued a press release stating that its company had received approval from the National Indian Gaming Commission (NIGC) for an on-line betting and Daily Fantasy Sports (DFS) platform.

The NIGC has not reviewed any DFS or on-line betting game for Atlantis Gaming Corporation and does not approve or license games for play in tribal gaming facilities

The NIGC Office of General Counsel may issue advisory opinions about games and technology at the request of a Tribe or other entity. Advisory opinions issued by the NIGC Office of General Counsel are only advisory in nature and based on information provided by the entity requesting the opinion. An advisory opinion was issued by the NIGC Office of General Counsel seven years ago in September 2009 for the Casino Gateway Network, which was a virtual private network (VPN), and was not an opinion on Internet gaming. The NIGC has not issued an opinion on Daily Fantasy Sports for Atlantis Gaming Corporation or any other entity.

“The Commission has received numerous inquiries about the Atlantis Gaming Corporation’s press release. The NIGC was not a part of the approval process described in this release and the Commission feels it is important to clarify our position,” said Chairman Jonodev O. Chaudhuri.
