The MGC unanimously approved a "preliminary order for disciplinary action" that recommends the LaGrange casino be fined $2,500 for the offense.
The casino has 30 days to appeal the recommendation or the action becomes final.
According to a document presented at the meeting, the violation involved two problems with a promotional program called "Pepsi Giveaway Mondays."
““The order signed by the MGC said state gaming laws require casinos to conduct all of their promotional activities in a fair and accurate manner, which didn't happen in this case
”
The document said the commission was notified on Monday, Nov. 2, that a promotional kiosk inadvertently printed too many tickets for the promotion's first day because the system had been set up incorrectly.
Then the following week a casino employee entered the wrong starting time for the Nov. 9 promotion. The error caused the promotion to start eight hours too early. This resulted in five casino patrons being denied their prizes, which consisted of a six-pack of soda and a cooler bag.
The order signed by the MGC said state gaming laws require casinos to conduct all of their promotional activities in a fair and accurate manner, which didn't happen in this case.
"The acts or omissions of employees or agents of the Company, as described above, caused the promotion to be conducted in a manner that reflects negatively on the licensee and constituted the failure of the Casino to conduct its promotions according to the licensee's rules governing the event," the document states.
LeAnn McCarthy, a spokesman for the MGC, said the commission initially recommended a $5,000 fine be imposed against Mark Twain Casino. However, the amount of the fine was amended to $2,500 on a motion by Commissioner Tom Neer, and the commission voted unanimously in favor.
