(US).- The Iowa Racing and Gaming Commission denied an appeal by Penn National Gaming to keep the Argosy riverboat casino in Sioux City, Iowa, open past July 1st. The Iowa panel had previously ordered the casino to cease operations on July 1.Penn National appeared in state court yesterday to seek an emergency stay against the order.

The Iowa Racing and Gaming Commission has refused to suspend its order that the Argosy riverboat casino in Sioux City must close.

Attorneys for the Argosy’s operator, Penn National Gaming Co., on Wednesday asked the panel to let the casino remain operational at least until August 1st, the scheduled opening date for the Hard Rock Hotel & Casino Sioux City. The panel refused.

In another effort to keep the casino open, Penn National lawyers will argue at a court hearing Thursday that a state judge should grant an emergency stay of the commission’s order.

The Argosy’s pending closure stems from the commission’s decision to allow a land-based casino in downtown Sioux City to replace the Argosy. Penn National lost its bid to operate the land-based casino to Sioux City Entertainment.
