The concessionaires are being fined a total of 2.5 billion euros. In 2007, 98 billion euros in penalties were initially sought, 4 billion euros of which was charged to Lottomatica Group’s subsidiary Lottomatica Videolot Rete. The Corte dei Conti quantified Lottomatica Videolot Rete’s responsibility at 100 million euros.
Lottomatica Videolot Rete maintains that the ruling does not take into consideration numerous and essential elements contained in the consultation requested from Digit Pa by the Corte dei Conti itself. Such elements, together with those sustained by Lottomatica Videolot Rete, should prove, de facto, the complete absence of responsibility by Lottomatica Videolot Rete.
Moreover, the court opinion does not in any way recognize that there is evidence of loss of revenue for the state which, as stated in the opinion itself, "given the impossibility of calculating the effective loss sustained", has been calculated using a method devoid of any foundation.
For these reasons Lottomatica Videolot Rete, having consistently stated and demonstrated the full compliance of its business and operations management, will appeal against the court ruling.
Lottomatica Videolot Rete’s appeal submission will suspend ex lege the execution of the ruling until the appeal case is resolved.
