This measure is consequence of the legal actions initiated by Codere against several companies dedicated to operate gaming and betting services through Internet from Spain.
Codere is promoting the strictest compliance of the law in force in the gaming and betting sector. Currently, several companies dedicated to operate Internet gaming and betting have entered in the market. Those services are available for users located in Spain.
According to statements by the government, both in the Memory of the Gaming Law and in recent answers to the European Commission, such activities are illegal as long as they are not authorized, and they are also being developed without paying taxes, without guarantees for users and damaging the operators that are legally operating in the market. Codere shares these statements.
The court order, from December 15, 2011, adopts the injunctive relief of cessation and prohibition of the online gaming activities in Spain, gaming advertising, obtention, use or transfer of personal data obtained through online activities and the cessation or prohibition of sending personalized or massive communications through e-mail related to online gaming activities.
The precautionary measure has been adopted considering that unfair competition acts are being performed and that the “bets that are being held circumstantially by future co-defendants, and the urgency is specially clear in cases in which there is an Internet advertising”, the court concludes.
For several months, Codere has been developing some actions that tend to preserve the company’s rights. Besides, the firm stated that it wants to contribute to the fact that the principles of transparency and equal rights are complied within the granting of licenses in the legalization process of such activities, and that competitive advantages of access to the legal market are prevented in favor of those who have developed these activities in an illegal way.
