The Swedish Supreme court gives negative judgement

(Sweden).- Local governments often have different opinions on internet gaming, particularly its regulation. The same applies for the ILT – Internet Lottery Terminal – from JENSIgame. After 32 successful court cases, the Swedish Supreme court surprisingly gives negative judgement – next step European Court of Justice.

JENSIgame is a pioneer in the field of internet gaming terminals. The ILT - Internet Lottery Terminal - from JENSIgame has already been in operation for several years. The firm is defining the market for the ILT in several countries in Europe. The clear goal of the company is to bring the ILT into a clear legally defined market. Local politicians need to understand that this gaming segment is truly international.

Jens Göransson is the founder and owner of JENSIgame. He has many years of experience of fighting the corner for this market and explains, “Traditionally gaming has been regulated on a country, even state level. The days of internet changed this. Politicians still at times do not wish to come to terms with this. It is our duty to inform politicians of the market as it is today. At times we have to fight our case in law courts. We have a very successful track record of this”.

Nevertheless, after 32 consecutively court cases won in Sweden concerning the operation of the ILT, the Högsta Domstolen (Supreme court) has ruled against this. “We did not expect this judgement as we have a long history of successfully fighting for our rights. We are very confident of our position so our next step is to take this to the European Court of Justice”, notes Göransson.

The cases were lost as the court took a standpoint of organising vs. locations, accepting domestic major (state) companies but not external companies as clearly stated as being a requirement by the EU/EEC. “This is in our view a strong breach of fundamental EU regulations and will be a issue for the EU court. The Supreme court was not united”, explains Göransson.

JENSIgame continues to play a defining role in allowing land-based operators offer internet gaming. Thus, JENSIgame is bringing land-based and online gaming together.
