According to Encinas, the Constitutional Court will be the entity in charge of defining if it infringed or not what was established in Article 3 of the Supreme Decree 24446, related to the period of time in which the license will be valid for the casino operation. While it does not occur, he said the Watchdog's report will be a preliminary version, which established signs of criminal responsibility in its activity.

Encinas Cuéllar admitted the suscription of the contracts with the two companies which were granted casino licenses (Tournaments Star Bolivia S.R.L. for two years and Importaciones Oddy S.R.L., also for two years), a situation that was observed by the Watchdog's Office.

Encinas said she issues the licenses based on the Administrative Resolution 055/04 (2004) and the Borrad Resolution 019/05 (2005), which have been approved by its predecessors, within Article 3 of Decree 24446, because it considers that the Constitutional Court should establish the unconstitutionality of these resolutions, due to the legal interpretation of the concept that says that the licenses are valid for a special period of time.
