 "The best thing for Brazil is a regulatory framework that covers every gambling vertical"

Even if the evangelical lobbyists’ pressure remains strong in Congress, the journalist trusts the judiciary to allow for the opening of the gambling market in Brazil. If the Supreme Court admits Extraordinary Appeal ‘RE 966.177’ all verticals will be legalized in the largest Latin American country.

The president of the Brazilian Institute for Legal Gaming (IJL in Portuguese) and editor of BNL DataMagnho José, was one of the speakers at the second edition of the Online Gaming Summit, organized by Clarion in São Paulo, on December 9-10. A supporter of gambling legalization in Brazil, he shared his views on the regulation of sports betting and the legalization of other gambling modalities in the territory. He participated in a discussion panel with Michael Pollock, Managing Director at Spectrum Gaming; and Moacir Rodrigues, a Paraíba state lawmaker.

At the event, Magnho also witnessed the participation of Waldir Marques, Subsecretary of Public Policies, Planning, Energy and Lottery (SECAP)— an agency of the Brazilian Ministry of Economy— in another discussion panel. Marques said that draft rules for the implementation of sports wagering will be submitted to the Office of the Attorney General of the Treasury Department (PGFN in Portuguese) and after that, to the Casa Civil  —the Chief of Staff’s Office— for publication. After the enforcement rules are issued, we will have to wait for 180 for sports betting operations to begin. He also explained that the enforcement rules will be based on the original text of Law 13.756 from 2018 and international best practice standards. "We hope to have a fully operational, regulated online betting market in six months," he said.

"Estimates depend on factors that go beyond SECAP’s control, such as the evaluations of government officials. We have no grounds to establish how long each review of the draft rules by the legal areas of government will take. Moreover, the PGFN has the authority to consult with other government agencies. Following that process, the draft rules have to be signed by President Jair Bolsonaro. The final step is the publication in the government gazette. Finally, it is worth noting that with Christmas and New Year’s Eve approaching, many officials are on holiday, so I would not risk stating an exact date for the operations to begin."

As regards the legalization of other gaming verticals, Magnho José remains optimistic: "as the president of the Brazilian Institute for Legal Gaming I am really looking forward to the Congress voting on one of two legislative proposals which have been brought forward, PL 442/91 and PLS 186/14. I believe the best thing for Brazil is a regulatory framework that covers every gambling vertical, including casinos in Integrated Resorts."

"We are also hoping that the Ministry of Economy will make the necessary amendments to Law 13,756/2018, which legalized sports betting, and enable the issuance of a regulatory order so operations can begin in 2020," he concluded.
