A draft regulatory decree is expected by next October

High Court against gaming limitation in Balearic Island

(Spain).- A recently High Court decision declared void under law the Article 1 of Decree 34/2001 on Gaming Limitation in Balearic Island, which restricted granting operating concessions for gaming machines type B (AWP).

hus, until the adoption of a new decree by the Government, the installation of new slot machines in bars has been liberalized, a situation which, as said General Director of Balearic Interior Council, Sebastià Amengual , worry regional gaming operators.  The government is reviewing a decision to prepare an emergency decree allowing to return to previous status, desired by gaming companies.

Amengual said that on the middle of August , they had a meeting with the gaming associations to discuss the implications of the decision of High Court - issued on June 30 and published yesterday in BOIB (Balearic Official Gazette).

Although due to the current economic crisis a substantial increase of slot machines is unlikely, a number of which was frozen in 1999 at around six thousand in all over the Autonomus Community, balearic operators are concerned and fearing any entrance of peninsular companies into Balearic market, affecting local businessmen.

The High Court's decision is based on the fact that neither Government had a regulatory power in 1999, nor now. The Interior Council expects to have a draft regulatory decree next October.
